Respellr (“Respellr“, “Company“, ”we“, “us“) is committed to maintaining robust privacy protections for its users, in particular children. This Privacy Policy explains how we collect, use and safeguard your personal information, as well as your rights and choices, in connection with our Platform and Services.

Platform“ refers, collectively, to our website (www.respellr.com), the Respellr extension and dashboard, mobile application, and any other related products and services.

Services“ refers to our services accessed via the Platform, in which users can replace standard spell check tools with the Respellr extension, which analyzes text, collects and stores spelling words, analyzes accuracy, and assesses and provides reporting tools relative to student progress while using the software.

WHAT INFORMATION DO WE GATHER ABOUT YOU?

Information Collected through Our Platform and Services

Information You Voluntarily Give Us

  • For Registration: When you register, we collect your contact information and account credentials. Once you’re registered, we assign you a unique ID number. This ID number helps us recognize you when you’re signed in.
  • For Billing: To process payments, we collect and use your payment information. This can include your name, your address, your telephone number, your email address, your credit or debit card information, bank account information and any other relevant information

Information Collected Automatically

  • Identifiers and Device Information: When you visit our services, including our websites, apps, email communications and newsletters, our servers automatically log information about the device you are using, including unique identifiers. If your browser doesn’t accept our cookies or similar technologies, you may have difficulty accessing certain parts of our Platform/Services. The items we log include: your IP address; cookie identifiers; your operating system and browser (e.g., type, version, and configuration); your browser language; and device identifiers (such as MAC address). We may combine this data with other information we collect about you.
  • Other Usage Data: We collect certain internet and network activity on our services, including our websites and apps, such as the URLs of any pages you visit on our sites and apps, the URL of the website from which you came to our sites, how long you spent on a page, access times and other details about your use of and actions on our services.

Information We Create or Generate

We do not infer new information from other data we collect, such as using automated means to generate information about your likely preferences or other characteristics.

WHAT DO WE DO WITH THE INFORMATION WE COLLECT ABOUT YOU?

We use each of the categories of personal information described above for the following. The activities below can involve outside companies, agents or contractors to whom we disclose your personal information for these purposes.

We Provide the Platform

We use your information to help you use and navigate our website and services, such as:

  • Making the Services available to you
  • Arranging access to your account
  • Providing customer service
  • Responding to your inquiries, requests, suggestions or complaints
  • Completing your payments and transactions
  • Sending service-related message

We Provide the Services

The Services analyze your text, and stores words along with other data associated with the analyzed text.

We Carry Out Administrative Tasks

  • For auditing: We verify that our internal processes work as intended and comply with legal, regulatory and contractual requirements.
  • For fraud and security monitoring: We detect and prevent cyberattacks or unauthorized robot activities.
  • For customer satisfaction: We assess users’ satisfaction with our website and services and our customer care team.

We Aggregate (or De-identify) Personal Information into Larger Findings

Sometimes we aggregate or de-identify information so that it can no longer identify you, as defined under applicable laws. This helps us better understand and represent our users. We can use and disclose this aggregated or de-identified information for any purpose, unless an applicable law says otherwise.

TO WHOM DO WE DISCLOSE THE INFORMATION WE GATHER?

With Service Providers

We may work with service providers to carry out certain tasks, including:

  • Processing your payments
  • Maintaining technology and related infrastructure
  • Offering you customer care
  • Presenting surveys
  • Distributing emails
  • List processing and analytics
  • Managing and analyzing research
  • Managing promotions

When performing these tasks, service providers often have access to your personal information. We may sometimes allow them to use aggregated or de-identified information for other purposes, in accordance with applicable laws.

Currently, our service providers are:

  • Google Oauth: loginaccess to Google Docs
  • Google Docs API: processing document content without storing it in order to detect spelling errors, and updating document content (correction of spelling errors)
  • Gmail SMTP: automated sending of emails
  • AWS: storage of static assets in S3 service
  • Stripe: purchase of subscriptions (yearly & monthly options are offered) for accessing the Respellr dashboard
  • PayPal: purchase of subscriptions (yearly & monthly options are offered) for accessing the Respellr dashboard
  • Gramma: grammar check library which internally uses languagetool.org; grammar check for document content from Google Docs (authorized by user); service claims not to store the texts that are being checked
  • LanguageTool: a free online proofreading service for English, Spanish, and 30 other languages.

RespellR's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

With Other Third Parties

Respellr does not share, sell, rent or lease any of your personal information except as set forth herein.

The following provides more information about the circumstances in which we may be disclosing personal information to third parties that are not service providers.

  • We process payments you make with external services. There are two ways this can happen: (a) We collect your information and provide it to the third-party service for processing; and (b) the third-party service collects your information for processing.
  • In the event of a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings), we would have a legitimate interest in disclosing or transferring your information to a third party — such as an acquiring entity and its advisers.
  • We can preserve or disclose personal information if the law requires us to do so. We can also preserve or disclose personal information if we believe it would be necessary to: comply with the law or with legal process; protect and defend our rights and property; protect against misuse or unauthorized use of the website or services; cooperate with government authorities, which could be outside your country of residence.

We provide a variety of ways for you to control the personal information we hold about you, including choices about how we use that information. In some jurisdictions, these controls and choices are enforceable as rights under applicable law.

In General

Communications Preferences

We may offer a variety of commercial emails and email newsletters. You can unsubscribe from them by following the instructions near the bottom of the email. You can also email us at info@respellr.com.

Access, Correct, Change/Update, Delete or Restrict Processing of Your Personal Information

In some jurisdictions, you may exercise the following choices:

  • Access, modify or delete the personal information we have about you
  • Be informed of or receive an electronic copy of the personal information we have about you, for data portability.
  • Restrict, or object to, how we process personal information about you.

Browser and Platform Controls

  • Cookie Controls: Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our Platform/Services. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated.
  • Email Web Beacons: Most email clients have settings which allow you to prevent the automatic downloading of images, including web beacons, which prevents the automatic connection to the web servers that host those images.

California Privacy Rights

If you are a California resident, you have certain rights with respect to your personal information.

Rights to Know, Correction and Deletion

“Do Not Sell or Share My Personal Information”

If you’re a California resident, you have a right to opt-out from the “sale” or “sharing” of your personal information with third parties who are not our service providers (as those terms are defined under the California Consumer Privacy Act and the California Privacy Rights Act, or “CCPA” for short in this Policy). To exercise this right, click the Do Not Sell/Share My Information link on the bottom of the webpage where your information is being collected. You can also submit a request to opt-out by emailing us at info@respellr.com with the subject line “California Resident - Do Not Sell or Share.”

Right to Limit Use and Disclosure of Sensitive Personal Information

You have a right to limit our use of sensitive personal information for any purposes other than to provide the services or goods you request or as otherwise permitted by law. To opt-out from such additional purposes, contact customer care.

California “Shine the Light” Privacy Rights

Under the California “Shine the Light” law, California residents can opt out of our sharing of their information to third parties (and sometimes affiliates) for their direct marketing purposes. To do so, please contact customer care.

HOW LONG DO YOU RETAIN DATA?

We store your personal information for as long as needed, or permitted, based on the reason why we obtained it (consistent with applicable law). This means we might retain your personal information even after you close your account with us. Rather than delete your data, we might de-identify it by removing identifying details.

HOW DO YOU PROTECT MY INFORMATION?

We protect your personal information with appropriate organizational, technological and physical safeguards — but we cannot guarantee its absolute security. We recommend that you use complex and unique passwords for your account. Do not share your password with anyone. If you have reason to believe your interaction with us is no longer secure, notify us immediately.

HOW IS INFORMATION TRANSFERRED INTERNATIONALLY?

We are headquartered in the United States. If you are located outside the United States, your information is collected in your country and then transferred to the United States — or to another country in which we (or our affiliates or service providers) operate.

WHAT IS OUR LEGAL BASIS?

In some jurisdictions, like the European Union and the European Economic Area, we only collect, use or share information about you when we have a valid reason. This is called a “lawful basis.”

It means that there are good reasons for the processing of your personal information, and that we take measures to minimize the impact on your privacy rights and interests. “Legitimate interest” also refers to our use of your data in ways you would reasonably expect and that have a minimal privacy impact.

We have a legitimate interest in gathering and processing personal information, for example: (a) to ensure that our networks and information are secure; (b) to administer and generally conduct business; (c) to prevent fraud; and (d) to conduct our marketing activities.

HOW ARE CHANGES TO THIS PRIVACY POLICY COMMUNICATED?

We are always improving our products and services. These updates sometimes require us to collect new information or use what we already have differently. Further, the laws regarding personal information and privacy frequently change. As a result, we must periodically update this Privacy Policy. We will post any changes on this page by updating this policy. If we make a significant or material change in the way we collect, use or share your personal information, we will notify you at least 30 days prior to the changes taking effect. We will do this via email or prominent notice within the website. If you object to any change, you can stop using our website and services. PRIVACY POLICY FOR CHILDREN UNDER THE AGE OF 13

The Children's Online Privacy Protection Act of 1998 and its rules (collectively, "COPPA") require us to inform parents and legal guardians (as used in this policy, "parents") about our practices for collecting, using, and disclosing personal information from children under the age of 13 ("children"). It also requires us to obtain verifiable consent from a child's parent for certain collection, use, and disclosure of the child's personal information.

This policy notifies parents of:

  • The types of information we may collect from children.
  • How we use the information we collect.
  • Our practices for disclosing that information.
  • Our practices for notifying and obtaining parents' consent when we collect personal information from children, including how a parent may revoke consent.
  • All operators that collect or maintain information from children through our Platform and Services.

This policy only applies to children under the age of 13 and supplements our general privacy policy. Only our general privacy policy applies to teens and adults.

Terms that are defined in the general privacy policy have the same meanings as used in this Privacy Policy for Children Under the Age of 13.

Information We Collect from Children

Children can access many parts of the Platform and Services and its content and use many of its features without providing us with personal information. However, some content and features are available only to registered users, requiring us to collect certain information, including personal information, from them. In addition, we use certain technologies, such as cookies, to automatically collect information from our users (including children) when they visit or use the Platform and Services.

We only collect as much information about a child as is reasonably necessary for the child to participate in an activity, and we do not condition his or her participation on the disclosure of more personal information than is reasonably necessary.

Information We Collect Directly

A child must provide us with the following information to register with this website: the child's first name, last name, birthdate, parents’ names, teachers’ names, school names, zip code and a parent's email address. We also require the child to create a member name and password. We may request additional information from your child, but this information is optional. We specify whether information is required or optional when we request it.

We enable registered users to communicate with others on or through the Platform and Services through chat, email, images and posting to public areas. The nature of these features allows children to disclose personal information about themselves. We do not monitor or review this content before it is posted, and we do not control the actions of third parties with whom your child shares his or her information. We encourage parents to educate their children about safe internet use and to monitor their children's use of social features.

Automatic Information Collection and Tracking

We use technology to automatically collect information from our users, including children, when they access and navigate through the Platform and Services and use certain of its features.

The information we collect through these technologies may include:

  • One or more persistent identifiers that can be used to recognize a user over time and across different websites and online services

How We Use Your Child's Information

We use the personal information we collect from your child to:

  • register him or her with the Service;
  • communicate with him or her about activities or features of the Service that may be of interest; and
  • track his or her performance in games or other activities.

We use the information we collect automatically through technology and other non-personal information we collect to improve our Service and to deliver a better and more personalized experience by enabling us to store information about the child's preferences, allowing us to customize the content according to individual interests.

Our Practices for Disclosing Children's Information

We do not share, sell, rent, or transfer children's personal information other than as described in this section.

We may disclose aggregated information about many of our users, and information that does not identify any individual or device. In addition, we may disclose children's personal information:

  • To third parties we use to support the internal operations of our Platform and Services and who are bound by contractual or other obligations to use the information only for such purpose and to keep the information confidential.
  • If we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Respellr, our customers or others, including to:
    • protect the safety of a child;
    • protect the safety and security of the Platform; or
    • enable us to take precautions against liability.
  • To law enforcement agencies or for an investigation related to public safety.

If we are involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding or event, we may transfer the personal information we have collected or maintain to the buyer or other successor.

Accessing and Correcting Your Child's Personal Information

At any time, you may review the child's personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using the child's information.

You can review, change, or delete your child's personal information by:

  • Logging into your child's account and visiting the account profile page.
  • Sending us an email at info@respellr.com. To protect your privacy and security, we may require you to take certain steps or provide additional information to verify your identity before we provide any information or make corrections.

Operators That Collect or Maintain Information from Children

A list of all operators that may collect or maintain personal information from children through the Platform or Services is available at Privacy Policy. Please direct inquiries about any third-party operator's privacy practices and use of children's information through the contact information provided on the list.

No other third-party operators may collect or maintain personal information from children through the Platform or Services.
